Deregister, travel on, stay anywhere less than 183 days: As a promise, that sounds convenient. It is not enough to justify tax exemption. I think this reduction is dangerous because it confuses travel planning with a tax audit.

A Perpetual Traveler is not automatically tax-free. The decisive factors are actual housing conditions, stays, income and entrepreneurial activities. A deregistration alone does not answer these questions any more than a calendar with a few days per country. This article looks at the German starting point. The rules of each other country concerned and the applicable double taxation agreement must be examined separately.

Why the deregistration does not decide the tax residence

After § 1 EStG In principle, a residence or habitual residence in Germany leads to an unlimited income tax liability. The tax residence depends on the actual circumstances. Section 8 AO asks whether an apartment remains available under circumstances that suggest its retention and use.

Therefore, a still usable apartment in Germany belongs in the examination. Who is in the lease? Who owns keys? How is the apartment actually used? A mere postal address is different from an available apartment. Even property alone does not answer the question of use. Notification deregistration does not replace this factual examination.

In the case of habitual residence: § 9 AO a continuous stay of more than six months; Short-term interruptions are not taken into account. Even the general circumstances can indicate a not only temporary stay. For less than six months, therefore, there is no general exemption. For certain purely private stays, the regulation also contains its own exception.

What the 183 Days Actually Mean

The known figure comes, among other things, from rules on the distribution of the taxation right for wages. It is not a global residency test. The Federal Ministry of Finance explains the requirements for wages: In addition to the length of stay, the employer and the question of whether a permanent establishment in the country of activity bears the remuneration regularly count. The conditions must be met together.

In addition, the agreement concerned may cover a calendar year, a fiscal year or a period of 12 months. A turn of the year therefore does not necessarily set the bill back. For self-employed income, corporate profits, rents or distributions, this wage rule cannot be applied in a lump sum.

I would first write down the type of income and the specific pair of countries. Only then does a daily count make sense. Even a correct allocation of taxation law does not mean tax exemption in both states.

What tax liability can remain after the departure

If the unlimited tax liability actually ends, domestic income can still be subject to the limited tax liability. § 1 (4) EStG refers to this § 49 EStG. German real estate income or certain operating income must therefore also be considered after a move. The specific type of income and possible agreement limits remain crucial.

In addition, § 2 AStGZZ create an extended limited tax liability. For this, homelessness alone is not enough. Among other things, the regulation requires at least five years of unlimited tax liability as a German within the last ten years before its end, low foreign taxation or lack of foreign residence as well as essential economic interests in Germany. Further entry limits and details shall also be checked.

This is separate from the exit tax. Section 6 AStGZZ. In the case of registered shareholdings, taxation without sale may arise under other conditions. Deregistration does not automatically trigger this for every person. Even immediate full payment is not a flat-rate correct statement: On request, seven equal annual instalments are provided, regularly against security. Special rules for investment shares belong to the separate technical examination for corresponding assets.

View the traveling person and their company separately

A company does not receive tax freedom through the travel plan of its shareholder. Section 10 AO For the place of management, focuses on the business overhead line. For corporations covered, § 1 KStG the place of management or the registered office in Germany already establish the unlimited corporate tax liability.

Who actually runs the current business? Where are decisions prepared and implemented? What tasks do other people really take on? A register entry abroad does not answer these questions. Conversely, a single business call from Germany does not yet prove a German central point.

Premises also require their own inspection. Section 12 AO in principle, links to a fixed business establishment or investment; Agreements can further limit the assessment. Neither every laptop location nor every hotel accommodation is automatically a business premises. Who one form a company will, should describe these actual processes before the location decision.

What Banks Need to Clear from Permanent Travelers

A functioning bank access is a separate requirement. Required of German obliged persons § 11 GwG Identification details. For new accounts of natural persons § 13 FKAustG In principle, a self-report on tax residence and its plausibility check is provided. Changes may require new information.

This results neither in a worldwide account ban for travelers nor a commitment from any bank. Before leaving, the specific institute should explain in writing what information and evidence it accepts in the event of changing places of residence. Private account and business account are to be clarified separately. Entering a foreign address as an alleged residence does not solve an unexplained residence.

Budapest Tools: Five Exams Before Next Booking

I would order the preparation in that order. This is a working framework for documents and responsibilities, not tax release.

  1. Cover housing conditions: Compile available housing, rights of use and actual stays per country with supporting documents. Keep planned trips and already realized facts separate.
  2. Allocate income: Individually list wages, self-employment, investments, real estate and capital gains. For each position, clarify which national law and which agreement are relevant.
  3. Describe corporate governance: Document decision-making powers, places of work, contracts and ongoing processes. Do not equate company with the private person.
  4. Bank access confirms: Requirements for address, residency, identification and business activity directly at the institution. Responses and changes comprehensible.
  5. Complete the technical assessment: Clarify open questions with responsible tax consultants and, if necessary, lawyers in the countries concerned. If the route or activity is changed, have the assessment checked again.

This order corresponds to my Methodology for preparing sustainable structures: first the actual situation, then the implementation. A table with travel days helps with this. It does not replace the examination of available dwellings or the assessment of each source of income.

Where my jurisdiction ends

I am Norbert Péter, entrepreneur and coordinator, neither lawyer nor tax consultant. I arrange documents, participants and processes. The individual legal and tax assessment belongs to approved professionals.

My attitude remains clear: permanent travel is a life choice. A robust tax classification arises only from the actual circumstances and the applicable rules. Deregistration and daily counting are only parts of the documents.
